These terms govern your use of Rostr and outline our commitment to providing a reliable service while protecting user rights.

1. Acceptance of Terms
Welcome to Rostr ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our restaurant management platform and mobile application (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
2. Description of Service
Rostr is a restaurant management platform that provides:
- Employee scheduling and shift management
- Team communication tools
- Cleaning checklist management
- SMS notifications and invitations
- Mobile and web applications for restaurant staff
3. User Accounts and Registration
3.1 Account Creation
To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
4. SMS Communications and Consent
SMS is used exclusively for one-time invitations to join organizations and download the Rostr app. No ongoing, recurring, marketing, or promotional SMS is sent. SMS is optional—consent is not required for employment, joining an organization, receiving schedules, or using Rostr.
4.1 SMS Consent Requirements
Managers and organization administrators may only send SMS invitations after obtaining explicit, voluntary consent from the individual. Consent must be separate from any employment, onboarding, or service requirement and cannot be implied by providing a phone number for work purposes.
Consent is not mandatory; opting for alternatives has no impact on employment, joining the organization, or using Rostr.
Acceptable methods (document where obtained):
- Standalone checkbox on forms/apps: "I voluntarily consent to receive one one-time SMS invitation from Rostr to download the app and join my organization. I understand this is optional, not required for employment or using Rostr, and I can be invited via email or in-person instead."
- Verbal agreement using scripted language: "Would you like to receive one one-time text message from Rostr inviting you to download our app and join the team? This is completely optional—you can join via email or in-person. Do you consent? (Yes/No)" (logged by manager)
Required:
Consent cannot be bundled with employment or required to access schedules or the Service. Message and data rates may apply.
4.2 Permitted SMS Content
SMS messages sent through Rostr are limited exclusively to one-time invitations:
- Invitations to join organizations and download the Rostr app
Restriction:
Rostr does not send ongoing SMS communications for schedules, updates, announcements, checklists, or any other purposes beyond the initial app invitation.
Example message (one-time only):
"Hello! You've been invited to join [Organization Name] on Rostr. Download the app and accept your invite here: [Link]"
Frequency: One message per invitation. No recurring messages.
4.3 Opt-Out Compliance
You agree to honor all opt-out requests immediately. Recipients may opt out by:
- Replying "STOP" (or equivalents like UNSUBSCRIBE, END, CANCEL, QUIT) to any SMS message
- Replying "HELP" for help
- Contacting their manager or organization administrator
- Using opt-out features within the Rostr application
You are responsible for maintaining opt-out lists and ensuring no further SMS invitation messages are sent to opted-out numbers. Opting out has no impact on employment, access to schedules/communications, or use of Rostr—alternative invitation methods (email, in-person) will be used.
4.4 SMS Service Provider Compliance
We use third-party SMS service providers (such as Twilio) to deliver messages. By using our SMS features, you agree to comply with:
- Twilio's Acceptable Use Policy
- CTIA Messaging Principles and Best Practices
- TCPA and all applicable federal and state messaging laws and regulations
5. Acceptable Use Policy
5.1 Prohibited Activities
You agree not to use the Service to:
- Send unsolicited or spam messages
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit harmful or malicious content
- Impersonate others or provide false information
- Attempt to gain unauthorized access to our systems
- Use the Service for any illegal or unauthorized purpose
5.2 Content Standards
All content uploaded to or shared through our Service must be appropriate for a professional workplace environment. We reserve the right to remove any content that violates these standards or applicable laws.
6. User-Generated Content and Safety Policy (EULA)
Rostr is a closed, private enterprise platform for internal employee scheduling and corporate communication. It is not a public social network. While users may register and create their own organization, each organization is closed and private. Employees cannot independently join an organization—an organization administrator (the business owner, franchisee, or designated manager) must explicitly add members to their environment.
Certain areas of the Service allow users to post, upload, transmit, or otherwise make available text, messages, communications, or other content ("User-Generated Content"). By accessing our services, you agree to this End User License Agreement (EULA) and explicitly accept a zero-tolerance policy for objectionable content or abusive behavior.
6.1 Prohibited Behavior and Objectionable Content
You agree that you will not upload, post, or transmit any User-Generated Content that is:
- Defamatory, libelous, abusive, harassing, threatening, or invasive of another's privacy.
- Bigoted, hateful, racially or ethnically offensive, vulgar, obscene, or sexually explicit.
- Infringing upon any third-party intellectual property or privacy rights.
- Intended to advocate or incite illegal activity or violence.
6.2 Administrative Moderation and Oversight
Because Rostr is an enterprise-managed workplace tool, organization administrators serve as the primary moderators of their own environments. Administrators have full authority to:
- Add and remove users from their organization at any time.
- Delete or remove any objectionable content or internal communications immediately.
- Terminate an employee's access to the organization's workspace if company policies or these Terms are violated.
- Manage all aspects of their private business environment to ensure a safe and professional workspace.
6.3 Flagging, Reporting, and 24-Hour Removal
- Flagging and Reporting: The application provides built-in tools allowing any user to flag or report objectionable content and abusive users to their organization administrator.
- Administrator Action: Organization administrators review flagged content and may immediately remove objectionable content and suspend or revoke access for any user who violates these terms or their organization's policies.
- Platform-Level Enforcement: ROSTR reserves the right to review escalated reports and take platform-level action, including removing objectionable content and suspending or terminating accounts, within 24 hours of escalation. We maintain the absolute right to act without prior notice when necessary.
Zero-Tolerance Commitment:
ROSTR enforces a strict zero-tolerance policy for objectionable content and abusive users across the platform. Organization administrators are empowered to act immediately within their environments, and ROSTR reserves the right to take platform-level action on any escalated report within 24 hours.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
8. Intellectual Property Rights
8.1 Our Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Rostr and its licensors. The Service is protected by copyright, trademark, and other laws.
8.2 User Content
You retain ownership of content you create or upload to the Service. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of providing the Service.
9. Service Availability and Modifications
We strive to provide continuous access to our Service but cannot guarantee uninterrupted availability. We reserve the right to:
- Modify or discontinue features of the Service
- Perform maintenance that may temporarily disrupt the Service
- Update these Terms from time to time
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the Service will cease immediately
- We may delete your account and data
- Outstanding payments will become due immediately
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
IN NO EVENT SHALL ROSTR, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
13. Indemnification
You agree to defend, indemnify, and hold harmless Rostr and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rostr is established, without regard to conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rostr regarding the use of the Service and supersede all prior agreements.
